The Equality Act 2010 makes it unlawful to ask a prospective employee questions about their health until they have made a conditional job offer.
Pre-employment or pre-placement health assessments, carried out as detailed questionnaires or face-to-face medicals, will advise the employer on fitness for work. In addition, advice will be given as to whether the individual is likely to be considered disabled as defined by the Equality Act 2010 and any potential adjustments that may be required by the prospective employee in the work place will be described.
